County DA's investigation of Joe Paulus comes to a halt

According to this morning’s Oshkosh Northwestern, the Winnebago County District Attorney’s office is ending its probe into possible criminal wrongdoing by former D.A. Joe Paulus. Why now? District Attorney Bill Lennon – also a candidate for Circuit Court Judge in Branch IV – says the workload in his office is too great to justify spending more time on the investigation. This, despite the fact that his office had said previously that they believed the criminal wrongdoing by Paulus went further than just the 22 cases he was convicted on and for which he is currently serving time in a federal prison. Lennon also vowed when he ran for D.A. four years ago that he was going to make things right in that office, if elected. Has that been accomplished, I wonder?

During a March 16 interview with “Eye on Oshkosh” Lennon stopped short of saying the investigation was coming to an end, but he expressed frustration with the way things had gone and the time it had taken. He also said he believed that his office had successfully restored the reputation of the D.A.’s office and the trust county residents place in it.

I certainly understand that to investigate matters such as this takes time. I also understand one has to prioritize what they do and when. But the DA’s office is the top law enforcement agency in the county and as such it has the responsibility of prosecuting crime when and where it exists. Do we know if there was any additional criminal activity found? Lennon would not say one way or another, but according to the Northwestern, any evidence of criminal activity will be forwarded to the Department of Justice for inclusion in its own ongoing investigation. Will part of that investigation be the destruction of files under the Joe Paulus regime? It’s okay that they were destroyed, provided they were put on microfiche, but it is my understanding that did not happen. So important records involving criminal cases are simply lost, is that it? If the law was not followed with respect to proper records maintenance and custodianship then one must wonder if people’s rights to due process and/or the appeals process have been denied, or at least compromised, as well. All these things factor in to the investigation being concluded.

Again, I understand the need to wrap things up when they’ve been fully and thoroughly investigated, but how do we know that has been done?

When interviewed by WHBY Radio recently Lennon called the Paulus situation and the investigation into it “serious and important matters.” In today’s paper he is quoted as saying “If we spend any more time wallowing in rumor and innuendo, we’re no better than Joe Paulus was.”

These comments seem to be in conflict with one another. Perhaps there is more to this than meets the eye and maybe Lennon cannot discuss things with more specificity than he has. But I for one hope the investigation was complete, not just halted midstream – though I have my doubts about this.

Either way, this announcement by Lennon will not likely bode well for his chances of election to Branch IV in the Winnebago County Circuit Court system. And if he fails to get elected there, it will be even more interesting to see how this plays out in his re-election bid for the D.A.’s office? Time will tell on both counts.

I agree... when he ran he promissed all the citiznes of Oshkosh that he would make it right.... now he says abruptly we are "ending" it.... sorry but "ending it" is not the same thing as doing it right. seems like lennon just wants to concentrate on his campaign.

dont get me wrong i do believe lennon did great things for the da office.. but you don't pull out of an investigation that has left a huge black eye on our county simply by saying we are "ending it"... you just dont. you follow it through and make sure it is concluded and done right. And if there are more casses that were affected I dont care about how much money or resources we are spending "GET IT DONE" we are talking about peoples lives ven if they are criminals it is not right. and for him to be running for Judge is even more appalling. We need CLEAR answers...... Was there more casses that were affected? only Lennon knows and he obviously is not sharing. Do we really want him for judge then? We already had one crook who turned the other way and at least he sided with the criminals.

Wow, what a disconnected post. When I read the news I thought of two things: they never got the information they thought they could get (remember, the only way the feds got Paulus was to build a case against his co-defendant Schierland and then have him wear a wire on his "friend"...Ann Galner got the investigation going from within the DA's office, but it took a deal with the other attorney to get the conviction). Try as they might (and I beleive they truly tried hard), they couldnt make the same case. Or, they did find more suspicious activity, but couldnt go any further because they did not have enough evidence to convict or they waited too long and the statute of limitations ran out on any charges.The comment to the original post assumes that the DA was close to charging but had to stop the investigation. I feel that is as far from the truth as it can be: if they were so close, they would have bought more time to investigate by indicating how successful the investigation has been and that in short time they would successfully conclude the investigation. The reality is probably that there wasn't enough there to validate going further.Lennon has received a great deal of criticism for spending resources and valuable time running after ghosts while real cases and real criminals go uncharged in that office. Lennon has certainly made some serious mistakes throughout his tenure as DA which may cost him his job inthe long run. However, the decision to "cut bait" was a good decision. We dont need more tax payer dollars spent on a personal fishing expedition in an effort to hammer a few more nails in the paulus coffin.I think the only thing "funny" about the press release is the timing. 2 weeks before the judicial election. It seems convenient that he now announces the need to focus on the job the voters elected him to do, while touting his professionalism and responsibilities to the people of Winnebago County by prosecuting the badest of the bad (see his recent TV ads on cable). I suppose if you are anxious to see more money spent on the Paulus re-invesitigation, wait until after the judicial election, he may need something to keep himself busy after the election.

While much of your comment seems to make sense I am curious as to what makes you think it was a personal fishing expedition that would have rendered no results?

Then show me the results...there are none. Government corruption is hard to prove yet alone investigate without someone from the "inside" assisting in the investigation. They tried, but failed. It's a good decision to back it up. You ask me Why I think there is nothing to find, why do you think there is something there? more so than what the feds found? I suppose I could hole up in my home and theorize about conspiracies day and night, but I have better things to do.

So why investigate any cases beyond the initial stuff presented? Better yet, let's do away with the DA's office. They refer everything to the Attorney General anyway.

So, simply because the DA found nothing or if they found something they referred it to a higher authority, the office is meaningless? The DA is given the task of charging people with criimes, ordinances, traffic tickets, juvenile cases, conduct inquests, offer opinions as to wrongdoing...they charge out over 2,000 criminal cases a year, 10,000 traffic tickets a year, and hundreds of other advisory opinions, they average a trial a week, Each attorney is in a courtroom 5 hours a day. Yeah, they are doing nothing important. In fact, they should probably drop all of the work they are doing and assign all of the assistant prosecutors to investigate Joe Paulus. You know what, despite his predicament, watching this charade from his cell, I am sure he has a pretty good laugh about now.Yeah, you're right. Lets spend all available resources to bring down the tarnished, disbarred, and incarcerated ex-DA from Winnebago County. (Psst, there is this guy named Alfonse Capone, I think he failed to pay his taxes in 1935, pass it on...)

Like not understanding the full duty of the DAs office, you also don't understand tongue in cheek sarcasm. Fact is you don't know there was nothing there to find so you can't make the comment you do about it being time to cut their losses and call it a day. If you do have some first hand knowledge tell us who you are so we can determine your credibility.

Aparently the only comments that can be acceptable (to you) are those that agree with you (by the way that is not sarcasm). The facts are the facts, no matter which words you are willling to read and which ones you intentionally ignore: The DA started an investigation...the DA spent years duplicating the federal investigation....the DA has ended the investigation. Either the DA found nothing (or not enough to sustain further resources to invesitgate) OR the DA just quit. I am inclined to believe the first (that they did not find what they wanted and could not afford to sustain the investigation)...you appear determined to believe the second. For all of Lennon's criticism, I doubt that if he was "onto something" he would just summarily quit. It is logical (I'm sorry to have to use logic) to assume that Mr. Lennon, who made it both his professional and personal crusade to unearth further corruption from the previous regime, had he found enough "evidence" (not rumors, not speculation, not hearsay, not assumptions) to continue to pursue this investigation, he cetainly would have...OR he would have come forward and touted his positive strides and successes in order to justify continued use of resources from within to go after Paulus despite the normal drudgery of the office (actual criminals committing actual crimes that need actual prosecution). He did neither. He suggested that the offic had to stop the investigation because they were too busy. (again slow down here because I am going to use logic again)..."Too busy": what has happened inthe last month or so that is different than the last 3 1/2 years? Nothing (except a judicial campaign). The same number of crimes are being committed, the same number of cases need to be filed, the same number of defendants are being tried. So, lets recap: The DA's office does lots and lots of things other than investigate Joe Paulus; the DA is busy running for judge; the DA's office, after 3 1/2 years has stopped the Paulus investigation; the DA's office did not leak the Paulus report (like the Kachinsky referral during the primary, one day after it was made, before an investigation was started, the DA leaked the referral to the public); the DA has said it is too busy to continue the Paulus inquiry (after 3 1/2 years of "not" being busy?)You boldly (without any support for your position) claim the DA was onto something and abruptly stopped. I have just spoon fed you a logical explanation for my comment. If you don't understand now, I am sorry for you; I can't drop my level of intelligence any lower to meet yours.

I doubt seriously Gritton is scared silly over FOB. Full of Bologna has a reputation of having the worst of the worst when it comes to cynics as regulars at its site. Is there some truth to some of the corruption stuff talked about over there? Probably but there is no way it is to the level those people claim and FOB has no more media attention than any other blog that has been around for a while.

FOB is a great title to that blog. They sure are full of it. I agree with the sentiment of many of the posts that ignore the FOB blog. They are conspiracy theorists with a vendetta (most have been convicted or have had loved ones convicted of a crime and are looking at some way to taint even the rightful conviction). I agree with the post about Eye on OShkosh. In the beginning, I thought this would become a conspiracy theorist maven, but Cheryl and many of the commenters in the blogs have made very valid points on many subjects. It saddens me that on the point of this original post, this thread has resorted to the type of garbage on FOB (I read the FOB threads because it was referred to in the paper once; I stopped reading them because they were ridiculous). It appears that the conspiracists from FOB are having a hard time finding an audience and have resorted to this blog. Good thing it is not hard to tell who they are.

This whole topic is typical of Cheryl Hentz trying to create news when there is nothing to be reported. She has a propensity for drumming up controversy where there isn't any, and this is just another fine example of that. It's her blog. I guess if she wants to make a mountain out of a molehill she can. She's great at it.

Hmm, every newspaper in the area reports on this as well as other media outlets. Attorneys are busily discussing it and some are even outraged over it. But you - in your infinite wisdom and with a superior sense of what is and isn't news - think it's a non-starter. It's doubtful you'd know news if it came up and bit you in the backside. Incidentally I didn't do the original story on this so maybe you should direct your comments where they are more appropriate. Athough comments like yours are typical of the ones you've made here and on other blogs and people are beginning to figure out your motives.

I also thought that Cheryl had written the original post. But unlike the poster chastising Cheryl, I beleive the post was very neutral and thought provoking; contrary to the FOB apologists who seem to resort to the lowest level of discourse (name calling). To whoever the original poster is...bravo! Your comments have created some very encouraging and insightful comments from at least the majority of the commenters on this post.

Hi Anonymous, please allow me to try to clear up some confusion. The original post on this web site was written by me. The original "story" I referred to in a previous answer to someone actually was a reference to the Oshkosh Northwestern article from which I wrote the opinion piece on this site. It can get confusing I know. But I guess the point I was trying to make is that I was accused of starting a controversy and I just was pointing out to that person that (a) there is something newsworthy here as the newspapers have covered it and (b) if the anonymous person wanted to criticize someone of trying to start a controversy they should direct their comments - however inappropriate and ill-conceived - to the newspaper that first reported on it.I hope that clears some confusion and I thank you for your kind words and comments.

I've read Ms. Hentz's original comments and frankly don't see where she's made a mountain out of a molehill. What I do see is she explained what the DAs office was doing, why it could be of possible concern, and she asked some reasonable questions. That someone like you can't see that is nearly as disturbing as Mr. Lennon's actions.
